Virtual Meetings, Electronic Voting Extended to September 30, 2022

The Government of Ontario has recently announced that the “Temporary Suspension Period” allowing virtual meetings and electronic communications will be extended until September 30, 2022, as the province continues to face challenges with COVID-19.

While the Temporary Suspension Period is in effect, the major changes are:

  • Virtual Owners’ Meetings. Condominium corporations may continue to hold meetings electronically without a by-law. Owners who attend virtually will be counted for quorum and can vote electronically. We still recommend that boards consider passing electronic meeting and voting by-laws as we do not know when/if the Temporary Suspension Period will be extended again, and corporations should have the flexibility to hold virtual and/or hybrid meetings (some appearing in person and some appearing virtually) in the future if required.

  • Virtual Board Meetings. Boards may continue to hold meetings electronically or on the telephone without the need for all board members to consent. Note that this change is not something that can be made permanent with a by-law.

  • Electronic Service. If the condominium corporation has an email for an owner, it may serve them electronically. They do not need to complete a consent.
