Proposed Expansion of Condominium Authority Tribunal Jurisdiction

The Ministry of Public and Business Service Delivery recently announced that it is seeking feedback regarding proposed amendments to the Condominium Act, 1998 which will expand the jurisdiction of the Condominium Authority Tribunal (“CAT”) to include disputes regarding owners’ meetings.

This change could potentially allow the CAT to hear disputes on topics including requisitioning a meeting, meeting timelines and procedures, meeting notices, quorum, and voting.

While the intent of the possible expansion is to provide condominium owners and corporations with a more accessible and cost-effective platform to resolve disputes, one possible unintended consequence is that condominium corporations may see a surge in CAT applications from unit owners unhappy with how a meeting has been run, or that they did not win the election. Previously, these disputes would be heard in the courts.

The Ministry is welcoming feedback on the proposed changes through this survey. Comments will be accepted until July 11, 2024.
